Terms of Service

Please read these Terms of Service carefully before using TidingsView. They govern your access to and use of tidingsview.com and all related services.

1. Acceptance of Terms

By accessing or using tidingsview.com ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. These Terms apply to all visitors, users, and others who access or use TidingsView. You must be at least 13 years old to use TidingsView. By using the Site, you represent that you are at least 13 years of age. To sign up for a business listing or to submit a content source for inclusion in TidingsView, you must be at least 18 years old. TidingsView only aggregates content from sources that are operated by individuals who are at least 18 years old, or by organizations. Additional terms may apply to specific services — for example, business listing subscribers are also subject to our Business Listing Agreement at tidingsview.com/business/terms. In the event of a conflict between these Terms and any applicable service-specific agreement, the service-specific agreement controls for matters within its scope. In the event of conflict across all governing documents, the order of precedence is: (1) the Business Listing Agreement for listing-specific matters, (2) the Privacy Policy for data matters, and (3) these Terms of Service.

2. About TidingsView

TidingsView is a geographic news aggregation and local business directory platform operated by TidingsView LLC, an Ohio limited liability company. TidingsView aggregates and displays publicly available content from third-party sources, including but not limited to RSS feeds, Atom feeds, JSON feeds, blogs, WordPress sites, published web pages, Substack publications, Medium publications, podcast feeds, YouTube channels, social media public pages, government and public agency websites, press release services, newsletter archives, and any other publicly available online publication or content stream, displayed on an interactive globe. TidingsView aggregates these publicly available feeds and content streams pursuant to the terms under which their publishers make them available. TidingsView is a technology platform, not a publisher or news organization. We do not create, edit, or endorse the news content displayed on the Site.

3. Use of the Site

You may use TidingsView for lawful purposes. You agree not to: • Use the Site in any way that violates applicable local, state, national, or international law or regulation. • Attempt to gain unauthorized access to any part of the Site, its servers, or any system or network connected to the Site. • Use automated tools, bots, scrapers, or spiders to access or collect content from the Site without our express written permission. • Interfere with or disrupt the integrity or performance of the Site or the data contained therein. • Transmit any unsolicited communications, spam, or promotional materials. • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity. • Post, submit, or transmit content that is defamatory, obscene, harassing, threatening, or otherwise objectionable. • Use TidingsView to compete with or resell TidingsView's services. Do not use TidingsView while operating a motor vehicle, bicycle, or any other vehicle, or while operating heavy machinery. TidingsView includes audio read-aloud and auto-scroll features that may require your visual or tactile attention. Distracted driving is dangerous and illegal. TidingsView is not liable for any accident, injury, disability, death, or damage resulting from your use of the platform while driving or operating any vehicle or machinery. We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any violation of these Terms or for any other reason at our sole discretion.

4. Third-Party Content

TidingsView aggregates and displays content from third-party sources, including but not limited to RSS feeds, Atom feeds, JSON feeds, blogs, WordPress sites, published web pages, Substack publications, Medium publications, podcast feeds, YouTube channels, social media public pages, government and public agency websites, press release services, newsletter archives, and any other publicly available online publication or content stream, published by independent news organizations, journalists, public agencies, and community publishers. We do not create, verify, endorse, or guarantee the accuracy, completeness, or reliability of any third-party content displayed on the Site. TidingsView is not responsible for the content of external websites linked from the Site. Links are provided as a convenience. In some cases, a source headline may be displayed without a direct link to the full article, where the originating source restricts or limits external linking to its content. Visiting a linked website is at your own risk and subject to that site's own terms and policies.

DMCA Copyright Infringement Notice

If you believe content displayed on TidingsView infringes your intellectual property rights, you may submit a notice to our designated DMCA agent in accordance with 17 U.S.C. § 512: Designated Agent: David Zimcosky TidingsView LLC 1837 Wembley Drive, Brunswick, OH 44212 Email: legal@tidingsview.com DMCA Registration Number: DMCA-1071659 Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material claimed to be infringing and its location on the Site; (3) your contact information; (4) a statement of good faith belief that the use is not authorized; (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature.

DMCA Counter-Notification

If you believe content was removed from TidingsView in error, you may submit a counter-notification to our designated DMCA agent at the address above. Your counter-notification must include: (1) identification of the material that was removed and the location where it appeared before removal; (2) a statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification; (3) your name, address, and telephone number; (4) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which TidingsView may be found; and (5) your physical or electronic signature. Upon receipt of a valid counter-notification, TidingsView will notify the original claimant and will restore the removed content within 10 to 14 business days unless the claimant files a court action seeking to restrain the alleged infringement.

Content Reporting and Moderation

If you encounter content on TidingsView that you believe is harmful, threatening, harassing, or otherwise problematic, you may report it using the Report button on any article card. Reports may be submitted anonymously — no account is required. We accept reports on the following grounds: threatening or violent content, harassment, adult content, misinformation, spam, or content that does not match the geographic region it is attributed to. TidingsView reviews reports and may respond by blocking a specific article from appearing on our platform, placing the originating feed on watchlist for increased monitoring, suspending the feed pending review, or permanently removing the feed from TidingsView. TidingsView is an aggregator of third-party RSS feeds. We do not author, edit, or control the content published by the sources we index. When we act on a report, our actions are limited to what we control on our platform — we cannot alter, retract, or delete the original content at its source. If you have a concern about content published by a third-party news source, we encourage you to also contact that publisher directly. Publishers' contact information is typically available on their own websites or publishing platforms. We make commercially reasonable efforts to review reports in a timely manner, with urgent reports involving threats of violence or safety concerns given priority. As a platform that indexes many third-party sources, we cannot guarantee real-time review of all flagged content. To report content, use the Report button on any article card. Data Breach Notification

In the event of a data breach that materially affects your personal information, we will notify you as required by applicable law. Please see our Privacy Policy at tidingsview.com/privacy for additional details.

5. Content Source Submissions

You may submit a content source for consideration to be included in the TidingsView directory. Content sources include, but are not limited to: RSS feeds, Atom feeds, JSON feeds, blogs, WordPress sites, published web pages and articles, Substack publications, Medium publications, podcast feeds, YouTube channels, social media public pages and accounts, government and public agency websites, press release distribution services, newsletter archives, community forums, sitemap-based content, and any other publicly available online publication or content stream. TidingsView is a feed aggregator. In addition to accepting source submissions, TidingsView uses automated tools to discover publicly available RSS feeds on domains of its choosing. These tools identify themselves as TidingsView Osprey and respect robots.txt directives on the domains they probe. By submitting a source, you are requesting that TidingsView index and display your publicly available feed alongside other sources covering the same geography. TidingsView does not supervise, moderate, or assume editorial responsibility for the content of submitted feeds. Each publisher remains solely responsible for their own content and for complying with all laws applicable to their publishing activities. By submitting a source, you represent that: • You are at least 18 years old. • You have the right to submit the source. • The source is operated by an individual who is at least 18 years old, or by an organization. • The source is a genuine publicly available publication — not spam, advertising, or deceptive material. • The content does not, to your knowledge, infringe third-party intellectual property rights.

Source Review and Removal

TidingsView's submission review is a structural eligibility check — we confirm that a feed is active, publicly accessible, and covers the geography it claims. We do not evaluate the editorial viewpoint, political stance, or journalistic quality of submitted sources. TidingsView reserves the right to reject or remove any source at any time, including feeds that: violate these Terms; are inactive, inaccessible, or returning errors; are not publicly available (including paywalled content); do not cover the geography they claim; consist primarily of spam, advertising, or deceptive content; have generated multiple valid user reports; have accumulated three or more valid DMCA notices; or do not meet platform eligibility criteria as determined by TidingsView in its reasonable discretion. TidingsView makes no guarantee that submitted sources will be approved or remain listed indefinitely. TidingsView runs an automated daily feed health check. A feed is automatically set to inactive if its most recent article is more than 45 days old, or if it returns repeated errors or an unreachable URL. Inactive feeds do not appear on the map. Inactive feeds may be automatically restored if fresh content is detected. Feeds that remain persistently inactive may be permanently removed. Feeds may be placed on watchlist for increased monitoring, suspended pending investigation, or permanently removed from TidingsView. Removal is permanent — deactivated feeds are not deleted from our records, as those records may be required for legal and compliance purposes. Three or more valid DMCA notices attributed to the same feed will result in permanent removal. We will make reasonable efforts to notify submitters of removal via email. If you believe your source was removed or suspended in error, you may submit an appeal by emailing legal@tidingsview.com with the subject line "Feed Removal Appeal." Include the RSS feed URL and a description of why you believe the removal was in error. We will review appeals and respond within 10 business days. TidingsView does not pay for submitted content and acquires no ownership rights over it. You retain all ownership of your content.

Source Analytics

TidingsView may collect aggregated, anonymized analytics on content performance — including article views and click activity — as part of normal platform operation. This data is used internally to evaluate content quality and platform health. News source owners do not currently have access to a self-service analytics dashboard. By submitting a source, you acknowledge that your content's performance on TidingsView may be measured in this manner.

Anonymous Source Recommendations

Users anywhere in the world may submit source recommendations anonymously via the "Recommend a Source" form at tidingsview.com/suggest. No account, email address, or personal information is required. To prevent spam, a one-way cryptographic hash of your IP address is stored for rate-limiting purposes only — your raw IP address is not retained. Anonymous recommendations do not constitute a formal submission and carry no guarantee of review, approval, or notification. TidingsView may use, modify, or discard anonymous recommendations at its sole discretion. By submitting a recommendation, you confirm that you are at least 18 years old, that the URL you are sharing is a publicly available news source operated by an individual who is at least 18 years old or by an organization, and that you are not submitting spam, deceptive, or unlawful content.

6. Business Listings

Businesses may apply for a paid listing in the TidingsView local directory. Business listings are governed by the Business Listing Agreement at tidingsview.com/business/terms, which is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Business Listing Agreement, the Business Listing Agreement controls for matters specific to business listings. Suspension or termination of a business listing is governed by the Business Listing Agreement.

The Tiding

Active business listing subscribers may post a "Tiding" — a short live update (up to 141 characters) that appears on the TidingsView globe alongside their business pin. Tidings are publicly visible. You are solely responsible for the content of your Tidings. Tidings must not contain false, deceptive, defamatory, harassing, threatening, adult or sexually explicit, spam, or unlawful content, and must not make false or misleading claims about competitors or other businesses. The full content standards applicable to Tidings are set forth in the Business Listing Agreement. TidingsView reserves the right to remove any Tiding that violates these Terms or the Business Listing Agreement at any time without notice. Where practicable, we will notify you via email if a Tiding is removed.

7. Intellectual Property

The TidingsView name, logo, platform design, software, and original content are owned by TidingsView LLC and protected by applicable intellectual property laws. "TidingsView" is a trademark of TidingsView LLC, application pending with the United States Patent and Trademark Office. You may not use TidingsView's name, logo, or trademarks without our prior written consent. You may not copy, reproduce, distribute, or create derivative works from TidingsView's software or original content without our express written permission. Nothing in these Terms grants you any license or right to use TidingsView's intellectual property except as expressly permitted.

8. Disclaimer of Warranties

TIDINGSVIEW IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content displayed on the Site, including third-party news content. You use TidingsView at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIDINGSVIEW LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TIDINGSVIEW'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE TOTAL AMOUNT YOU PAID TO TIDINGSVIEW IN THE THREE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless TidingsView LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) any content you submit; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Privacy

Your use of TidingsView is also governed by our Privacy Policy at tidingsview.com/privacy, which is incorporated into these Terms by reference. By using TidingsView, you consent to the data practices described in the Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. For material changes, we will make reasonable efforts to notify registered users via email at least 14 days before the changes take effect. Your continued use of TidingsView after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.

13. Termination

We may suspend or terminate your access to TidingsView at any time, with or without cause, with or without notice. Suspension or termination of a business listing subscription is governed by the Business Listing Agreement. If you wish to stop using TidingsView, you may simply stop. Sections 7 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 15 (Governing Law) survive termination.

14. Force Majeure

TidingsView shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, internet outages, third-party service failures, or government actions.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of TidingsView shall be brought exclusively in the state or federal courts located in Medina County, Ohio. You consent to the personal jurisdiction of such courts and waive any objection to venue.

16. Interactive Computer Service

TidingsView is an interactive computer service as defined under 47 U.S.C. § 230. TidingsView is not liable for content provided by third-party information content providers. Nothing in these Terms shall be construed to waive TidingsView's protections under 47 U.S.C. § 230 or any other applicable federal or state law protecting interactive computer services.

17. Miscellaneous

These Terms, together with the Privacy Policy and any applicable service-specific agreements, constitute the entire agreement between you and TidingsView LLC regarding your use of the Site and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. You may not assign your rights under these Terms. TidingsView may assign its rights without restriction.
